ABOUT THE WEBINAR:

The presentation will cover the compliance obligations for physician practices created by the significant changes and recent interpretations of the Stark Law and Anti-Kickback Statute Rules, and recent enforcement actions involving the Eliminating Kickbacks in Recovery Act (EKRA). 

Discussion of the recent amendments and clarifications to the Stark Law and Anti-Kickback Statute Rules that addressed in part structures of group practices, profit distribution and profit sharing requirements and physician compensation formulas for bonus and incentive compensation.\

Recent whistleblower suits under the False Claims Act have been based on violations of the Stark Law and Anti-Kickback Statute, and have resulted in personal liability for physicians. 

Discuss recent cases involving EKRA and lab services by physician practices, and clinical laboratory arrangements that may create liability under EKRA (and how to avoid liability).

Clay Countryman is a partner in the healthcare group in the Baton Rouge office of Breazeale, Sachse & Wilson, L.L.P.
