HHS provided guidance in 2016 regarding the patient’s right to access their PHI. This guidance provides information regarding charges and access that is drastically different from how many practices handle these types of requests. The following points are covered in my presentation:
• How patients can request access (email, fax, CD/USB)
• How much healthcare providers are allowed to charge for copies
• What to do when a patient wants their PHI sent to a third-party
• How to deal with attorneys who want access without an authorization
• What will happen if a patient complains about access

ABOUT OUR PRESENTER
Loretta Duncan, FACMPE is a Senior Medical Practice Consultant with the Medical Practice Services department of SVMIC. Prior to joining SVMIC in 2008, she was the Director of Practice Management for the Arkansas Medical Society. Loretta has over 20 years’ experience in healthcare, and currently specializes in HIPAA compliance. She is a board-certified Fellow in the American College of Medical Practice Executives and will complete her Master’s Degree in Health Law and Policy from the Cumberland School of Law in August 2017.
